Do you want to get involved in service delivery and/or advocacy related to your community interests, but aren’t sure how to go about organizing yourself in a legal structure that can receive funding? You should know that Kosovo’s Constitution and the Law on Freedom of Association in NGOs guarantee full rights to freedom of association and establishment of NGOs. These organizations should be not-for-profit and should pay only reasonable compensation to its staff for the work being done. They can be established in two forms – associations (created by three or more persons) and foundations (created by one or more persons). They should have strict internal rules and regulations as well as an organizational structures that ensure accountability towards its founders, donors and beneficiaries. All of these should be clearly elaborated in the NGO’s statute. If your NGO’s principal activities are those that serve public interests, you can get a public beneficiary status, which can make you eligible for tax and fiscal benefits.

If you want to establish an NGO, you need to apply for registration at the Department for NGOs which is part of the Ministry of Public Administration. You need to submit an application form, a founding instrument and a statute of your NGO. You should also designate in writing an authorized representative. By law you are required to get a decision on your registration within 60 days.

There could be legal reasons why your NGO registration application is denied, such as if you have incomplete documentation, if your statute violates any laws or if you have a name that is already being used by others. However, in case you feel that your application was unjustly rejected, you can appeal to a body of the second instance within the Ministry of Public Administration.
